PDP chief Mehbooba Mufti and the former chief minister of Jammu and Kashmir is going through a setback as the plea that has been filed by her has been disposed of by the J&K high court. The bench has been lead by justice Javed Iqbal Wani justice Tashi Rabstanad who have discredited her plea and therefore it has been disposed of them, in the plea she stated that he has the right to avail the remedy which is in availability to her according to the scheme but in order which was given on 29th March 2021, due to certain observations that were done by the learned Single Judge, she has been left with no other option but to appeal to a higher court in order to avail the remedy that she has been seeking.
The bench stated that they are disposing of the appeal and the appellant has a complete right to refer the case to a higher court in case she seeks to do so. The statement also included that the court she’d refer to should consider the case on its respective merits, following up the regulation and provisions of the particular act which should be unbiased and un-influential. Court has also stated that the petitioner which is Mehbooba mufti in this case has no right to demand a passport which is in her favor. They have also cleared that the Writ petition should not come in between her and her rights.
Now Mehbooba Mufti who is the former J&K chief minister can approach the chief passport officer and joint secretary, external affairs ministry in accordance to the refusal order that has been concluded by the passport officer within a time frame of 30 days.
This has been a long-running case that should be adjourned in the fastest way possible as this is about someone’s identity and situations like these should not take too much time.
